Four kindergarten-age children were killed when their bus was hit with the massive tsunami that followed the earthquake. The lawsuit claims that the school did not ensure the childrens safety during the incident, reported Kyodo news.

The suit may be the first of its kind to question the culpability of schools during the disaster. The parents are demanding around $3.5 million in total compensation from Hiyori kindergarten in Miyagi Prefecture, said the news agency.

In the suit, the parents accuse the school of not gathering enough information via the radio and other sources, and not following other safety guidelines.

Mika Sato, who lost her daughter, told Kyodo that she wants a sincere apology from the kindergarten, adding that she hopes that no parents have to go through the same ordeal.
