College student sentenced to 4-year imprisonment for rape
A Peking University student was sentenced to four years in prison after being convicted of raping his ex-girlfriend, according to a final judgment made by Beijing No.1 Intermediate People's Court, the Beijing-based Legal Mirror reported Monday.
The young man surnamed Chen and his victim, Miao, were from Jiangsu Province and were high middle school students together.
They fell in love after entering universities in Beijing. But their relationship did not last for very long. In May 3, 2009 Chen took her to a hotel, saying that he wanted to have a serious talk about their relationship. At the hotel, Chen raped Miao after she drank a cup of drugged mineral water.
Miao's new boyfriend reported the case to the local police after she told him of her experience. Miao told police that she felt weak after she drank the water and that Chen covered her mouth with his hand to ensure she made no noise, the report said.
In October 2009, Haidian District People's Procuratorate in Beijing charged Chen with rape.
However, just before his trial, Miao sent three letters to the local public security bureau, procuratorial office and people's court, 'At first, I was not willing รข€¦but he did not force me.'
After police investigated Miao's inconsistent statements, she admitted that she made them out of pity for Chen's family after they begged her for mercy many times.
On May 25, 2010, Haidian District People's Court in Beijing delivered a guilty verdict for Chen. But Chen appealed to the Beijing No.1 Intermediate People's Court.
The Beijing No.1 Intermediate People's Court on Sunday upheld the original verdict and held that it was clear that Chen raped his ex girlfriend after he deceived her into drinking the drugged water.
